User Licensing Agreement

License for the use of the invoiced prints, slides or digital files, (referred to as "photographs") is granted by Datamaster Designs to the buyer upon payment of the invoice. This is a license, not a sale. We continue to own the photographs provided to you in this package. The right to use the photographs is granted solely to the original buyer and cannot be transferred to any third party. Ownership and copyright to the photographs remains with Gary Todoroff.

Gary Todoroff grants the right to use of the photograph in accordance with international copyright law. The photograph may be used for the purpose(s) outlined in the Attachment to this license agreement. You must obtain our permission in writing for any other use of our images.

If license is for Internet use, then no photographs greater than 72dpi and 8x10 inches can be placed on-line in a downloadable or FTP format. The photographs may be manipulated through cutting, cropping, scaling, color changes, etc. Photographs may not be sold, sublicensed, distributed, given away or otherwise granted rights or made available for use by others, or placed on an electronic image system, in any format (other than the web-site 72dpi size) without our specific written permission.

It is a violation of this agreement to use these photographs to create pornographic, libelous, obscene or defamatory designs or images. The licensing agreement does not permit the purchaser to offer free or paid downloads of the photographs on the Internet or any internal and external networks including online services and BBS installations.

Photographs are provided "as is" with no warranties or conditions, expressed, implied, statutory, or in any communication with you. Gary Todoroff expressly disclaims any implied warranties of merchantability, non-infringement and fitness for a particular purpose. Gary Todoroff will not be liable to the purchaser of the photographs or any other third party for any damages, including loss of data, lost profits, or any other costs that are incurred, which are caused directly, incidental, consequential or indirect from the use of the photographs provided.

The term of the above license agreement is for the period outlined in the Attachment, from the date of invoice.

We kindly request a credit on published and web-site photographs that reads “ © Gary Todoroff ”.

This agreement is the entire agreement between the purchaser and Gary Todoroff and supersedes any other communications or advertising with respect to the photography provided. If any provision of this agreement is held invalid, the remainder shall continue in full effect.
